Accident Towing in Victoria: What You Need to Know

Been in a crash in Melbourne? Here’s how accident towing works, what your rights are, and where Gator Towing can help once your vehicle has left the scene.

First: stay safe

Stop, switch on your hazard lights and check whether anyone is hurt. Call 000 in an emergency.

Exchange details with the other people involved — names, addresses, registration numbers and the owner’s details if they’re not the driver.

Report the crash to police if anyone is injured and police didn’t attend, or if property was damaged and the owner isn’t present.

Take photos and notes, and avoid admitting fault at the scene.

Let your insurer know as soon as you can.

How accident towing works in Melbourne

Victoria separates towing into two categories. Trade towing covers breakdowns, planned transport and other non-accident work. Accident towing means towing a damaged vehicle from the scene of a crash, and it’s regulated.

In metropolitan Melbourne and the Mornington Peninsula (the “controlled area”), a tow truck for a crash involving vehicles under 4 tonnes is assigned by the government accident allocation centre, and the driver is given a job number. Only licensed accident tow trucks — which carry number plates beginning with TOW (or HTT for heavy tow trucks) — can do this work, and they can only attend if they’ve been allocated.

Your rights at the scene

Your vehicle can’t be towed until you (or police on your behalf) sign an Authority to Tow that sets out the services and charges.

You can choose where your vehicle is taken. Accident tow fees in the controlled area are set by regulation.

You don’t have to choose a repairer at the scene, and touting for repair work at accident scenes is prohibited.

If salvage work is needed (such as righting a vehicle), it must be listed on the Authority to Tow and photographed — you can request copies.

If your car goes to a storage depot, ask about storage charges and release hours.

For the latest official information, including current accident towing charges, see Transport Victoria’s tow truck information.

Where Gator Towing fits in

Gator Towing provides trade towing and vehicle transport. We don’t attend crash scenes in the controlled area unless lawfully allocated. Once your vehicle has left the scene — for example, it’s sitting at a holding yard, a repairer you’re not using, or your driveway — we can help move it to your chosen repairer, home, wrecker or buyer on a tilt tray.

Complaints

If something goes wrong, raise it with the towing operator first. Accident towing complaints can then be taken to Transport Victoria. Complaints about breakdown or trade towing go to Consumer Affairs Victoria.
